THIS DEED of Indemnity in made this day of _____________ by _______________son of ________________
WHEREAS I am the holder ________________admeasuring ______________ square meters.
AND WHEREAS I propose to construct a building over the said plot of land AND WHEREAS I have submitted the building plan for the construction of the building over the said plot of land for sanction with Building Plan, Online Application No. _______________dated ____________vide 45/58/89of MR & T.P. Act.1966 and under section 253 to 263 of the M.M.C. Act 1949.
AND WHEREAS for sanctioning of the building plan. I have given an undertaking in the form of an affidavit (copy enclosed) to the N.M.C.
AND WHEREAS N.M.C has agreed to sanction the building plan on The aforesaid undertaking :
NOW THIS DEED WITNESSES that in pursuance of the aforesaid affidavit and in consideration of N.M.C. having agreed to sanction of the building plan submitted Online Application No____________, dated ____________in respect of the plot of land situated at and referred to above, I hereby undertake to indemnity and keep harmless the N.M.C. from all proceedings in courts and before other authorities including the competent authority and other authorities appointed under the Urban Land ( Ceiling and Regulation ) Act 1976. All expenses / losses / claims which the N.M.C. may incur or become liable to pay as a result or in consequence, of the Sanction accorded by it to the building plan in respect of the aforesaid plot.
I further state that I and all my successors-in-interest shall abide by the aforesaid terms and conditions of this Deed of Indemnity.

1) That I am the plot owner of ________________ admeasuring _____________square meters.
2) That I propose to construct a building over the aforesaid plot of land.
3) That I have submitted the plan for the construction of a building over the side plot of land for sanction vide my letter dated No_____________________
4) That the aforesaid plot of land is the only plot of vacant land held by me in any of the urban agglomerations covered under the Urban land (Ceiling and Regulation) Act 1975 and that the extent of that plot is not within the ceiling limit on vacant land imposed by the said Act.

AFFIDAVIT
I, __________________ the undersigned, Applicant/Builder/Developer make an affidavit, that I have obtained the commencement certificate vide letter No._______________ Date __________ for the construction of the _____________ to construct a building as per approved building plan. As per the provision available in Unified Development Control & Promotions Regulation – 2020 vide Regulation No. 2.2 & 2.7, the Hon. Municipal Commissioner, Nagpur abide part occupancy / part occupancy according to Unified Development Control & Promotions Regulation – 2020 Clause No. 2.11, for the complete construction within stipulated period. I assure to get part occupancy certificate from the concern authority within stipulated period as per the circular.
I also give an affidavit that, allottees of the building are not entitled to enter in the building and not use the building prior to receipt of occupancy or part occupancy certificate.
I do follow all the guide lines mentioned in the Unified Development Control & Promotions Regulation – 2020 Clause No. 2.10 & 2.11, for the part occupancy or occupancy, for the construction of the building.
